In what may hopefully be the first of many favorable judicial rulings, Western Pennsylvania District Judge Arthur Schwab ruled on Tuesday that the declaration of amnesty by Jeh Johnson and Hussein Obama are “beyond prosecutorial discretion” and enter into the legislative sphere of authority.
In his determination, Judge Schwab was absolutely clear, writing, “President Obama’s unilateral legislative action violates the separation of powers provided for in the United States Constitution as well as the Take Care Clause, and therefore, is unconstitutional.”
The ruling was part of a decision in the case of Elionardo Juarez-Escobar, who was arrested for drunk driving. He had been deported prior to his arrest and re-entered the country illegally. The matter was addressed by Schwab in an effort to determine whether the individual Escobar specifically would be eligible for amnesty. In the ruling by the Judge, neither Escobar nor any of the other illegals Obama is trying to import as a voting bloc are eligible.
