Military Detention Law Blocked by New York Judge

Opponents of a U.S. law they claim may subject them to indefinite military detention for activities including news reporting and political activism persuaded a federal judge to temporarily block the measure.

U.S. District Judge Katherine Forrest in Manhattan yesterday ruled in favor of a group of writers and activists who sued President Barack Obama, Defense Secretary Leon Panetta and the Defense Department, claiming a provision of the National Defense Authorization Act, signed into law Dec. 31, puts them in fear that they could be arrested and held by U.S. armed forces.

The complaint was filed Jan. 13 by a group including former New York Times reporter Christopher Hedges. The plaintiffs contend a section of the law allows for detention of citizens and permanent residents taken into custody in the U.S. on “suspicion of providing substantial support” to people engaged in hostilities against the U.S., such as al-Qaeda.

Of course the problem is that Obama could consider the Tea Party as a threat to him and his march to power and he would be right.  In this both the left and right will agree for the opposite reasons to get rid of this law and of course the way the Supreme Court has been acting it would thrown out before it even reaches the court.

Poison darts favored by Hitler, Stalin and yes Saul Alinsky. Be very very scared. Look what happened to Andrew and one of the guys in the coroners office.

“Look what happened to Andrew and one of the guys in the coroners office”, also the only witness of what happened.

NO ONE, no matter what the crime, should be held on “suspicion” of a crime.  It’s one thing to haul someone in to question them regarding a matter; WITHOUT ARREST AND WITHOUT INCARCERATION WITHOUT TRIAL.  It’s another to jail them completely without trial by peers in an open court.  Their new “law” violates the provision of the Constitution so clearly that those who authored it should be in jail, those that signed and administered the law should be jailed, and all those that voted for the law should be censured or tossed from office.

    • RageFury says:

Those that signed and administered the law, and all those that voted for the law should all be charged, tried and sentenced for treason.

It’s possible the raghead might take out every member of the tea party. Maybe all should switch to communist party as a ruse and bury all guns in the veggie garden. And get rid of all hoodies. You know those hints advertised here for putting away food and water for the coming emergency go do that.

I agree….stock up on food and water….it won’t be long if you don’t you will wish you had.

“suspicion of providing substantial support” to people engaged in hostilities against the U.S”. Wide open for interpretation. Support can be Physical, Financial or merely Opinions.
What version of the U.S.? Substitute ‘U.S.’ with ‘U.S. Constitution’ and I might agree.
Regardless of their actions, activities and intents, every US citizen must be given their Constitutional Rights including Warrants, Speedy Trial, Jury of Peers, Facing Accusers, Cruel & Unusual Punishment, etc.

What puzzles me is why would our congress and senate give Obama and his misjustice department this authority in the first place. Guys like John McCain and Lindsey Graham are traitors in my view.

  9. Ken says:

The govt is trying to preempt the Constitution with all these draconian laws because they know they are wrong & they are afraid of what the American people will do to them if we finally figure out how much they have stolen from us.

  10. Ken says:

Please consider the words of Congressman Ron Paul:

“Strictly speaking, it probably is not necessary for the federal government to tax anyone directly; it could simply print the money it needs. However, that would be too bold a stroke, for it would then be obvious to all what kind of counterfeiting operation the government is running. The present system combining taxation and inflation is akin to watering the milk: too much water and the people catch on.”

  15. R. Young says:

Just who does this judge think she is that she can block a “LAW” designed to protect people?

    • Slate54tx says:

read the whole law it is designed to detain/imprison anyone deemed a threat to Obama or the establishment,,,, according to Reid and Polosi it is any citizen or resident that does not agree with them
